Terms of Service

These terms are an agreement between you and Lex Professional Development Group Inc. ("we", "us"), an Ontario corporation operating as NCA Tutor, LexPD and OntarioBarExam.com. They apply to our websites, study materials, courses, tutoring and online practice examinations. By purchasing or using any of them, you agree to these terms.

What you are buying

You are buying a personal, non-transferable, non-exclusive licence to use our materials and services for your own exam preparation. You are not buying ownership of any content. We may add, improve, retire or replace products over time.

Practice exams are delivered on our online platform. Access is tied to the email address used at checkout — you must sign in with that same address. Digital materials such as indices are delivered as downloads through our store.

Your account and access are personal

Access is for one person: you. You must not share your account, sign-in link, downloads or materials with anyone else, and you must not sell, lend, sublicense or transfer your access.

You must register using your true and complete name and a valid email address that belongs to you, and keep that information accurate.

To protect our materials we monitor for signs of sharing, including sign-ins from multiple locations and unusual patterns of use, and we may limit an account to one active session at a time.

Suspension and termination

We reserve the right to suspend or permanently disable your access, at our discretion and without refund, where we reasonably believe that you have:

  • registered or purchased using false credentials, including a false name, or an email address or identity that is not your own;
  • shared your sign-in details or account with any other person, or allowed another person to use your access;
  • copied, transcribed, recorded, distributed or republished any of our content contrary to these terms;
  • breached any other provision of these terms.

Where access is disabled for any of these reasons, no refund of any kind will be provided, and any remaining attempts, downloads or unused products are forfeited. This is in addition to any other remedy available to us at law. Where we can reasonably do so, we will tell you why access was disabled and give you an opportunity to respond.

Our content, and what you may not do with it

All questions, explanations, indices, summaries, reports and course materials are our intellectual property, protected by copyright. They are original works created by us.

You must not:

  • copy, reproduce, transcribe, photograph, record, republish or distribute any question, explanation or material, in whole or in part;
  • post our content to any website, forum, messaging group, file-sharing service or study group;
  • use automated means to extract content, or attempt to bypass any access restriction or security measure;
  • use our materials to build, train or improve any competing product, database or machine-learning system.

Screens within the platform may display your name and email address as a watermark. Unauthorised copying is a breach of these terms and of copyright law, and may result in immediate termination without refund in addition to any other legal remedy available to us.

Attempts, timing and accommodations

Each practice exam product includes a stated number of attempts. Timed exams run on a server-side clock; the on-screen countdown is a display only. Pausing a timed exam is intended for genuine emergencies and is limited — currently a maximum of three pauses per attempt, each lasting up to three minutes, after which the clock resumes automatically.

If the Law Society of Ontario has granted you testing accommodations such as additional time, contact us after purchase and before starting, and we will apply equivalent accommodations to your account at no extra charge.

Payment and refunds

Prices are in Canadian dollars and exclude applicable taxes, which are added at checkout. Payment is processed by our store provider.

All sales are final. We do not offer refunds. Because our products are digital and are delivered or made available immediately on purchase, they cannot be returned. You are asked to acknowledge this at checkout before completing your purchase. Please review the product description carefully before buying, and contact us with any question first — we would much rather answer it than have you buy the wrong thing.

If a technical fault on our side prevents you from accessing what you bought, tell us and we will fix the access.

Writing again: repeat access

If you are unsuccessful and need to prepare for a further sitting, you do not pay full price again. Repeat access is offered at a reduced rate that reflects the ongoing cost of running and maintaining the platform:

  • Complete Collection — renewed access for $120 + HST.
  • Barrister Complete or Solicitor Complete — renewed access for $50 + HST each.
  • Individual mock exams and quiz packs — these must be purchased again, at a 15% discount on the same product.

Indices are not renewed. Repeat access restores the exams and quizzes, together with the edition of the index you originally received. If you are writing in a new sitting, the licensing materials may have changed and you would need to obtain a current index separately. We do not guarantee that an updated index will be produced for any future sitting.

Acceptable use

Use our services lawfully and honestly. Do not attempt to disrupt, probe or gain unauthorised access to our systems, and do not misuse support channels. We may suspend or terminate accounts that breach these terms.

No affiliation with the Law Society of Ontario

We are an independent exam-preparation provider. We are not affiliated with, endorsed by, approved by, or connected in any way to the Law Society of Ontario. Terms such as “Ontario bar exam” are used descriptively to identify the examinations our materials help candidates prepare for. Our practice questions are written entirely by us and are not reproductions of, and do not derive from, any actual examination content.

No guarantee of results

Our materials are study aids. We do not guarantee that you will pass any examination, and your results on our practice exams do not predict your result on any licensing examination. Nothing we provide is legal advice, and nothing here creates a lawyer–client relationship.

Availability

We aim to keep the platform available at all times but cannot guarantee uninterrupted service, and we may carry out maintenance or make changes. We are not responsible for interruptions caused by your own device, browser or internet connection.

Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim relating to our services is limited to the amount you paid us for the product or service giving rise to the claim. We are not liable for indirect or consequential losses, including examination outcomes, lost opportunities or lost profits. Nothing in these terms limits liability that cannot be limited by law, including under applicable consumer protection legislation.

Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms; the effective date above will change, and continuing to use our services after an update means you accept the revised terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute, subject to any right you have under consumer protection law to bring proceedings elsewhere.
